Judge Tells Kostka: Clean Up Property by Next Court Date

Palatine filed a lawsuit against former village councilman, Warren Kostka, for various property violations.

A trial date will be set at the next court hearing in the village of Palatine’s lawsuit against former councilman, Warren Kostka, if he doesn’t clean up his property by then, a judge ruled Thursday. The two parties made a second Cook County Court appearance May 17 after the initial hearing on April 26 was extended so Kostka’s attorney could answer the complaint filed by the village. Palatine is taking Kostka to court over several alleged violations on his property at 108 N. Forest Avenue. In addition to a fine of $500 per day per violation, the village is seeking an injunction to force Kostka to correct the violations and to also pay the cost of the village’s legal fees. Kostka Clash Frustrates Neighbors; Court Hearing Extended

The next status hearing is set for May 17.

A handful of Warren Kostka’s neighbors that attended the April 26 court hearing to testify on behalf of Palatine didn’t get the chance to voice their frustrations over the state of Kosta’s deteriorating property. The two parties appeared briefly in Cook County Court Thursday, when Kostka’s attorney, Richard Belmonte, who appeared in lieu of Robert Egan, asked for an extension to answer the complaint filed by the village. Belmonte has until May 10 to answer the complaint, after which the next status hearing is set for May 17. “I came because I wanted to show my support for the village of Palatine,” said Pamela Panczyk, who lives two doors down from Kostka. Palatine, Kostka to Appear in Court Thursday

Palatine filed a lawsuit against the former village councilman for various property violations.

The first court hearing regarding the village of Palatine’s lawsuit against Warren Kostka is scheduled to take place Thursday, April 26 in a Rolling Meadows court room. In addition to a fine of $500 per day per violation, the village is seeking an injunction to force Kostka to correct the violations alleged and to also pay the cost of the village’s attorney’s fees. In January, the village conducted a visual inspection of Kostka’s property at 108 N. Forest Ave. and discovered several ordinance violations consisting of: Kostka claims that a federally mandated project to separate Palatine's sanitary sewer and storm water system in the 1980s resulted in flood damage to his home. Palatine Files Lawsuit Against Former Councilman for Property Violations

Warren Kostka claims that flood damage to his home was caused by Palatine. In January, the council rejected authorizing village staff to negotiate a purchase of his home.

Palatine is taking to court former councilman, Warren Kostka, over claims of several village violations on his property at at 108 N. Forest Avenue, according to an article in the Daily Herald. The violations listed in the complaint include deep trenches with unstable and hazardous side slopes, sand bags, spoiled piles of dirt, fabric fencing, asphalt and concrete remaining on the property, missing gutters and downspouts, broken pane of glass and driveway in disrepair, the article states. Although Kostka has taken it to the extreme, I wish more Palatine residents would speak up and stand up. When the Village came out to my house in the ‘80s to separate the sewer and storm water, their solution turned my back yard and half my patio into a lake. I couldn’t get rid of all the water. 'Want Water' Sign Returned To Homeowner

Palatine police found and returned a large sign that has been taken from Warren Kostka's home in the 100 block of North Forest Avenue.

Palatine police were able to locate and return a large sign that had been taken from the home of Warren Kostka. The sign is part of Kostka's ongoing dispute with the village over flooding issues. The sign states: "WANT WATER? Buy A Home In Palatine." The sign was taken on Jan. 6 at about 11 p.m. During the incident, someone threw a floodlight against a window of the Kostka home. The light broke a pane of glass, but did not go completely threw the window. Palatine Police Cmdr. Mike Seebacher said, "The information that was gathered was from an anonymous tipster, basically. Someone who was able to get us the sign back but they wanted to remain anonymous." Seebacher said the tipster was not involved in the theft. "So the sign has been …

Large Sign Taken From Palatine Home

Palatine resident Warren Kostka said someone stole a large sign from his home and threw a light against his front window.

Palatine resident Warren Kostka said that someone Friday night stole the large sign he had placed on the side of his home that referenced flooding issues in Palatine. The sign stated: "WANT WATER? Buy A Home In Palatine." The sign was part of Kostka's ongoing dispute with the village over flooding that has occurred on his property dating back to the 1980s. Palatine was federally mandated to separate its storm water sewer system from its sanitary sewer system and Kostka maintains that change created water issues that has left his home worthless. Palatine resident Warren Kostka believes the village should buy his home because of flooding problems. Kostka has maintained that a federally mandated project to separate Palatine's sanitary sewer and storm water system in the 1980s resulted in more water heading toward his home. Last week Palatine voted against authorizing village staff to negotiate a purchase. Village officials have said that they have offered to work with Kostka to address issues specific to his property. And they point to regional flood control projects, such as the Fairground Park storm water diversion. Should Palatine buy Kostka's home at 108 N. Forest Ave.?

The Palatine Village Council voted against authorizing negotiations for the purchase of a flood-damaged home on Forest Avenue.

Palatine resident and former village council member Warren Kostka has been a fixture at board meetings for months, pleading his case that Palatine should buy his flood-damaged home. Kostka has said that a federally mandated project to separate Palatine's sanitary sewer and storm water system in the 1980s resulted in more water heading toward Kostka's home at 108 N. Forest Avenue. The dispute has been over what to do about it, how much fault the village has and how much Kostka's home actually has been damaged by flooding.
