Palatine Case Against Kostka Case Continues to Moves Forward

At a court hearing Friday, Palatine lawyers said dangers and hazards remain on the property, but the case was continued until March 22.

The Palatine court case against resident and former councilman Warren Kostka continues to move forward, though lawyers for the village said in court Friday dangers and hazards remain on the property.  Still at issue are sandbags that Village Manager Reid Ottesen said are strewn about the property, and installation of gutters on the house at 108 N. Forest Avenue. Judge Margarita Kulys Hoffman continued the case until March 22 to give Kostka time to move the sandbags 'to a more appropriate place' and to install the gutters.  As steps toward compliance with the village's punchlist continue, Kostka is still considering whether to demolish a portion of the home, which according to him has experienced 25 years of water damage, or to rebuild from…

Palatine Case Against Kostka Makes Progress

Former councilman Warren Kostka has adhered to a judge's order to fix dangerous and hazardous on his property. The case will be revisited in mid-January to ensure all compliance issues are taken care of.

After months, and even years of issues, the home owned by Warren Kostka, former Palatine village councilman, at 108 N. Forest Avenue is currently in compliance with a court order issued by a Cook County Circuit Court judge.  During a Thursday hearing in the case, which was initially filed by the Village of Palatine in March, Judge Margarita Kulys Hoffman accepted testimony from Village of Palatine Attorney, Patrick Brankin.  "The previous order entered required that certain work be performed by November 23 and that has been taken care of by Mr. Kostka," Brankin said. That work included the removal of tarp on the roof of the home, and righting dangerous conditions that did not provide for proper ventilation in case of a fire.  The case …

Kostka Ordered to Take Action on Property

Cook County Judge Margarita Kulys Hoffman ruled that Warren Kostka must remove boards from windows and tarp from his roof in 30 days, and comply with village code violations in 60 days.

Cook County Circuit Court Judge Margarita Kulys Hoffman ordered Warren Kostka to remove boards and tarp from an addition on his home within the next 30 days, and to comply with violations identified by the Village of Palatine within 60 days.  "This has been a long time and something needs to get done before winter," Hoffman said. Village of Palatine Attorney Patrick Brankin asked for time limits to be set to require Kostka to make the repairs to his home, while his lawyer, Robert Egan stressed the process, and decisions Kostka must make shouldn't be rushed.
